Terms and conditions

In accordance with Spanish Law 34/2002 on information society services and e-commerce (LSSI-CE), the owner's details are:

Futransfer is a digital platform that connects clubs' sporting directors with football agents holding a valid, verified FIFA licence.

• Futransfer is not a scouting agency and does not provide representation services: under the FIFA Football Agent Regulations (FFAR), only licensed football agents may provide them (art. 11).
• Futransfer takes no financial part in deals and charges no transfer or per-deal commissions.
• Futransfer is a complementary channel: it requires no exclusivity from clubs or agencies.

The services are aimed exclusively at football professionals: authorised staff of clubs and sporting departments, football agents with a valid FIFA licence and, through the showcase, adult independent players and technical staff members.

• Whoever sends a request declares they are authorised by the club to do so on its behalf.
• Futransfer verifies the request, normalises it and opens it to agencies without identifying the club: the club's name is never shown to agencies.
• Futransfer screens licences and mandates and delivers 2 to 3 profiles that fit the request.
• If the club is interested in a player, Futransfer quickly puts it in touch with the player's agent, with no intermediation fee. From then on, dealings are direct between both parties.

Futransfer does not guarantee that a request will result in a deal.

• Each football agent must provide accurate details and their valid FIFA licence number, together with the document proving it.
• Agencies operate through their licensed agents. Agency employees who are not football agents may not provide representation services or contact prospective clients for that purpose (art. 11.3 FFAR).
• Futransfer may check the licence and refuse registration if it is not proven.
• Futransfer periodically checks the validity of licences with FIFA. If none of the agency's agents holds a proven, valid licence (for example, because it is suspended, revoked or expired), Futransfer will notify the agency and, if it does not regularise the situation within 15 days of the notice, may suspend or cancel its access. No further subscription charges will be made from the suspension or cancellation. Amounts already paid are governed by section 8.
• A licence is not considered to be lacking when Futransfer has been unable to verify it with FIFA for reasons beyond the agency's control.
• The agency must report any suspension, withdrawal or expiry of its licence.
• The agency is responsible for how its users use the platform.

• Only players over whom the agent can prove standing may be presented, through one of these routes: a valid representation agreement with the player (art. 12 FFAR), a representation agreement with the releasing club, or a collaboration agreement with the agent who represents them, which must have been uploaded to the FIFA Agent Platform (art. 16.2 FFAR).
• Proposals for a player under an exclusive representation agreement with another agent are not accepted without that agent's collaboration (art. 16.1 FFAR).
• In each transaction the agent may act for one party only. Dual representation is only accepted between the player and the engaging club, with both parties' prior written consent (arts. 12.8 & 12.9 FFAR).
• Only agents who have completed FIFA's course on representing minors, and who respect the contact restrictions of art. 13 FFAR, may present minors.
• The agent is solely responsible for complying with the FFAR, their member association's rules and their reporting obligations to FIFA. Agent fees are agreed exclusively between the agent and their client: Futransfer neither receives them nor takes part in them.
• Futransfer may discard proposals that don't fit the need or lack proven standing, stating the reason.

• Players without an agent and technical staff members who are adults and have no representation agreement in force with any football agent may register (arts. 13 & 16.1 FFAR).
• The profile is only shown to Futransfer's verified agencies, inside the platform; it is not published on the website.
• Contacts arrive through Futransfer and the person freely decides who to talk to. No exclusivity, no commitment.
• Futransfer does not represent players or coaches. Any representation agreement is signed directly between the person and the agent, under the FFAR.
• Access to the showcase is currently free. If the terms change in the future, notice will be given in advance and no fee will apply without express acceptance.

• Basic Plan: €14.90 per month or €149.90 per year. Applicable taxes are shown during checkout.
• Free trial: 7 days from the verification of the agent's FIFA licence. Before any charge, Futransfer will clearly explain the terms for moving to the paid subscription.
• No lock-in: the subscription can be cancelled at any time, effective at the end of the period already paid. Started periods are not refunded, unless due to an error attributable to Futransfer. Nor are they refunded when access is suspended or cancelled for lack of a valid licence (section 5), even if the period is ongoing.
• Futransfer may change prices with at least 30 days' notice. The change applies from the next renewal.

Clubs' needs, profiles and any information received through Futransfer are confidential. Users undertake to:

• Use it only for the purpose of the platform.
• Not try to identify the club behind a request.
• Not disclose, copy or publish screenshots or data from the platform.

Providing false data, impersonating others, automated data extraction, sending unsolicited communications and any unlawful use are prohibited. Futransfer may suspend or cancel the access of anyone breaching these terms.

The Futransfer brand, website, platform and their contents belong to their owner or are used under licence. They may not be reproduced or exploited without authorisation.

• Futransfer is not a party to deals between clubs and agents, and is not liable for agreements, payments or breaches between them.
• Futransfer aims to keep the service available at all times but does not guarantee uninterrupted operation.
• Futransfer's liability towards an agency is limited, at most, to the amounts that agency paid in the previous 12 months.

Personal data is processed in accordance with our Privacy policy.

Futransfer may update these terms. We'll always publish the current version with its update date and notify registered users of relevant changes.

These terms are governed by Spanish law. Unless applicable rules provide otherwise, any dispute will be submitted to the courts of Málaga (Spain).
